These Terms & Conditions ("Terms") govern your access to and use of the digital visiting card service provided by Smart Business Card ("we", "us", "our"). By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Service" — the digital visiting card service, website, mobile features, and associated functionality.
  • "User" — any person or entity using the Service, including account holders and visitors.

2. Eligibility

You must be at least the minimum age required by applicable law to use this Service and capable of forming legally binding contracts. By registering you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features you may create an account. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately of any unauthorized use.

4. Use of the Service

  • You may use the Service to create, send, receive, and manage digital visiting cards and related contact sharing features.
  • You must not use the Service for illegal activities, spam, harassment, or to upload harmful content, malware, or copyrighted content without permission.

5. Content & Intellectual Property

Unless otherwise stated, we and our licensors own all rights to the Service and its content. You retain ownership of the personal content you upload (e.g., your name, photo, contact details), but you grant us a limited license to operate and display that content for the purpose of providing the Service.

6. Paid Plans & Billing

If you choose a paid subscription, you agree to pay the fees and taxes. Payments are processed by third-party providers and are subject to their terms. Refunds are handled according to our Refund Policy (if any). We may change prices with notice to you; such changes do not affect completed payments for past periods.

7. Termination & Suspension

We may suspend or terminate your access for violations of these Terms, illegal activity, or for technical or security reasons. You may delete your account at any time; account deletion may not immediately remove all copies of your information from backups.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, in no event will Smart Business Card be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data, or business interruption arising from or related to your use of the Service. Our aggregate liability for direct damages will be limited to the amount you paid us in the 12 months preceding the claim, or USD 100 if you did not pay us.

10. Indemnification

You agree to indemnify, defend, and hold harmless Smart Business Card and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or breach of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India without regard to conflict of law principles. For disputes, the parties will attempt good-faith negotiation. If unresolved, disputes may be brought in the competent courts located in Delhi.

12. Changes to Terms

We may modify these Terms at any time. If changes are material, we will provide notice (e.g., email or in-app). Continued use after changes constitutes acceptance of the updated Terms.
